공식 규정 - 1 Hotel 샌프란시스코 - 마사 스투멘 경품(이하 "경품행사")

스폰서: "스폰서"는 델라웨어 주에 소재한 1 Hotel San Francisco, 8 Mission St, San Francisco, CA 94105의 델라웨어 법인인 SF TREAT LESSEE, INC.

공식 규칙에 대한 동의

By participating, you (“Entrant”) agree to abide by and be bound by these Official Rules (“Rules”) and the Terms and Conditions (“Terms”) set forth below, which are final and binding in all matters relating to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Sponsor reserves the right to interpret and apply these Rules and Terms in its sole discretion, and to modify or terminate the Sweepstakes at any time.

이용 약관

참가 대상: 본 경품행사는 미국(미국령, 영토, 외국의 해외 군사 시설, 미국 50개주 외의 지역, 앨라배마, 아칸소, 애리조나 델라웨어, 인디애나, 노스다코타, 로드 아일랜드, 유타, 버몬트(총칭하여 "부적격 지역") 제외)의 21세 이상 합법 거주자만 참가할 수 있습니다. 후원사, MS Wines LLC d/b/a Martha Stoumen Wines 또는 SH Group Hotels & Residences U.S., L.L.C.(총칭하여 "경품 제공자") 및 이들의 각 계열사 및 자회사의 직원 및 이들의 직계 가족(배우자, 부모, 형제자매 및 이들의 각 배우자, 거주 지역에 관계없이) 또는 이러한 개인과 동일한 가구에 거주하는 사람은 관계 여부에 관계없이 경품에 참가하거나 경품을 수령할 자격이 없습니다. 본 경품행사는 미국 이외 지역 및 법으로 금지된 지역에서는 무효입니다. 

참가 방법

경품행사는 후원사가 공지를 게시하는 시점(아래 정의)부터 시작하여 2024년 2월 20일 오후 11시 59분(PT)에 종료됩니다("응모 기간"). 후원사는 경품행사의 공식 시간 기록 장치를 통제합니다. 경품행사는 응모 기간 시작 시점에 경품행사 참가를 권유하는 후원사의 인스타그램 계정(@1hotel.sanfrancisco)과 마스 스타우멘의 인스타그램 계정(@marthstoumen)의 공동 게시물로 발표되며, 해당 게시물에는 본 규정 및 약관 링크가 포함됩니다("발표"). 

응모하려면 응모 기간 동안 인스타그램에서 @1hotel.sanfrancisco, @terrene.sf, @marthastoumen, @heathceramics, @coyuchi 및 @caseformaking을 팔로우하고, 공지에 '좋아요'를 누르고 공지에 참가자가 당첨자인 경우 상품을 공유하고자 하는 추가 참가자의 인스타그램 계정을 태그하여 댓글을 달면 됩니다. 참가하려면 참가자의 소셜 미디어 프로필이 공개되어야 합니다. 참가 자격을 갖추려면 참가자의 댓글에 부적절하거나 모욕적인 내용이 포함되어서는 안 되며, 이를 준수하지 않는 응모작은 실격 처리되고 후원사에 의해 삭제될 수 있습니다. 개인 또는 단체가 제출한 자동 또는 로봇 응모작은 실격 처리됩니다.

예비 참가자가 아직 Instagram 회원이 아닌 경우, Instagram.com을 방문하여 링크 및 지침에 따라 플랫폼의 회원이 될 수 있습니다. 자격을 갖춘 참가자가 정회원이 되면 경품행사에 응모할 수 있습니다. 

응모 기간 동안 1인/인스타그램당 1개의 응모로 제한됩니다. 로봇, 프로그램, 스크립트, 매크로 또는 기타 자동화된 응모(총칭하여 "자동 응모")는 허용되지 않습니다. 자동 응모 또는 동일인/인스타그램 계정으로 여러 번 응모한 경우 실격 처리됩니다. 본 경품행사는 Instagram이 후원, 보증 또는 관리하거나 이와 관련된 어떠한 방식으로도 진행되지 않습니다. 본 경품행사와 관련된 모든 질문, 의견 또는 불만사항은 Instagram 또는 당사가 아닌 후원사로 보내야 합니다. 응모함으로써 귀하는 본 규정에 동의하는 것으로 간주됩니다.

The Sponsor is not responsible for late, misdirected, or delayed entries. No mechanical reproductions or facsimiles of entries allowed. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.

상품: 상품 1개:

One (1) grand prize winner (the “Winner”) will receive a one-night weekend stay at 1 Hotel San Francisco, dinner for two at @terrene.sf, a Spring/Summer 2024 6-bottle shipment from @marthastoumen, two waffle-knit robes from @coyuchi, two espresso cup sets from @heathceramics, a box of single-origin truffles from @dandelionchocolate, and a watercolor painting set from @caseformaking (the “Prize”). 

상품의 대략적인 소매 가치("ARV")는 $1,600입니다. 대략적인 소매가와 각 구성품의 실제 비용 간의 차액은 지급되지 않습니다.

Dates of the one-night stay at 1 Hotel San Francisco shall include check-in on a Friday (with check-out the next day on Saturday) or check in on a Saturday (with check-out the next day on Sunday) and must be confirmed by Winner and Sponsor and take place before December 31, 2024. Any Winner unable to travel to 1 Hotel San Francisco between the specific dates may be ruled ineligible to win. In such event, the Prize may be awarded to the next eligible Entrant. The Prize is nonrefundable and nontransferable. Winner must be 21 years of age or older. Guests must be 18 years of age or older or Winner must be the parent/legal guardian of a guest under 18 years of age. Sponsor is not required to (but may at its sole discretion) offer any substitutions, cash redemptions, or alternative to prizes awarded under this Sweepstakes. Sponsor reserves the right to substitute a prize of equal value in the event a prize is unavailable. Recipients of prize must have a mailing address within the United States of America with the exception of residents of the Ineligible Locations who are not eligible. Any Prize awarded is subject to the restrictions and limitations noted in these Rules, on the Prize and/or included with the Prize.
 
Transportation between Winner’s and guest’s home(s) and 1 Hotel San Francisco, additional meals, gratuities, rental car, optional entertainment, incidental expenditures at the hotel, departure taxes, customs and agriculture fees, and all other expenses not specifically mentioned herein are Winners’ responsibility. No responsibility is assumed by Sponsor for canceled, delayed, suspended or rescheduled flights (including, but not limited to, flights affected by weather, nature, or acts of God) and no refund or compensation will be made in such instance. Travel restrictions, conditions and limitations may apply. 

All federal, state, and local taxes and fees, including income tax, sales tax, and any other expenses arising out of the receipt and use of the Prize, are solely the responsibility of the Winner. Any difference between the stated estimated value of the Prize and its actual value will not be awarded. Winner agrees to accept Prize “as is.”

The Winner will be selected in a random drawing from among all Entries received during the sweepstakes period. The drawings will be held on February 21, 2024 by the Sponsor or a party acting on its behalf, whose decisions are final and binding in all matters relating to this Sweepstakes. The Winner will be notified via direct message on Instagram from @1hotel.sanfrancisco and will be required to respond within twenty-four (24) hours of such notification or the Prize will be forfeited and a replacement Winner shall be selected in a random drawing from among all remaining Entries received during the sweepstakes period. The replacement Winner will be notified via direct message on Instagram from @1hotel.sanfrancisco and will be required to respond within twenty-four (24) hours of such notification or the Prize will be forfeited. The aforementioned process for selecting and notifying a replacement Winner shall repeated until a Winner responds.  No liability is assumed for any Winner notification that is lost, intercepted or not received by a potential Winner for any reason.

당첨자에 의한 상품 양도, 양도 또는 대체는 허용되지 않습니다. 후원사는 상품을 사용할 수 없는 경우 상품을 대체할 수 있는 권리를 보유합니다. 

경품행사 홍보 자료에 포함된 공개 또는 기타 진술과 본 운영원칙의 약관이 불일치하거나 불일치하는 경우, 본 운영원칙이 우선하여 적용됩니다.

기타 이용 약관

우승자는 우승자 및 게스트의 이름, 음성 및 초상이 후원사와 그 지정자, 라이선스 사용자 또는 계열사에 의해 게시될 수 있으며, 이러한 사용과 관련하여 우승자 또는 게스트에게 추가 대가를 지불하거나 추가 승인을 구할 필요가 없음을 인정하고 이에 동의합니다. 

특정 제한 사항이 적용될 수 있습니다. 

후원사는 단독 재량에 따라 (a) 웹사이트를 조작하거나 소셜 미디어 계정에 무단 로그인을 시도하거나, (b) 본 규정을 위반하거나 비신사적이거나 방해하는 방식으로 행동하는 것으로 간주되는 개인의 자격을 박탈할 수 있는 권리를 보유합니다. 주의: 고의로 웹사이트를 손상시키거나 경품행사의 합법적인 운영을 훼손하려는 시도는 형법 및 민법 위반에 해당하며, 그러한 시도가 이루어지는 경우 후원사는 법이 허용하는 최대 한도 내에서 그러한 시도에 책임이 있는 자에게 손해배상 또는 기타 구제를 요청할 권리를 보유합니다. 

면책 및 책임의 제한. 경품행사에 참여함으로써, 응모자는 경품행사에 참여하거나 경품의 수령 또는 사용 또는 오용 및/또는 경품 관련 활동 참여로 인해 발생하는 모든 소송 원인으로부터 후원사, 경품 제공자, 그 부모, 관련, 계열사 및 자회사 및 각 해당 임원, 이사, 직원, 대리인, 유통업체, 판매 담당자, 광고 및 홍보 대행사("면제 당사자")를 면제하고 면책하는 데 동의하며 이에 포함되지만 이에 국한되지 않습니다: (a) 응모자가 응모작을 제출하지 못하게 하는 기술적 오류, (b) 경품행사에 대한 사람의 무단 개입, (c) 인쇄 오류, (d) 분실, 연체, 우편요금 연체, 잘못된 방향 또는 배달되지 않은 우편물, (e) 경품행사의 관리 또는 응모작 처리의 기술적 또는 기타 오류; 또는 (f) 직간접적으로, 전체 또는 부분적으로 발생할 수 있는 사람 또는 재산에 대한 상해, 사망 또는 손해(징벌적, 결과적, 직접적 또는 간접적 손해 포함)에 대해 방출 당사자는 오류, 누락, 중단, 삭제, 결함, 작동 또는 전송 지연, 통신 회선 장애, 도난 또는 파괴 또는 응모작에 대한 무단 접근 또는 변경에 대해 어떠한 책임도 지지 않습니다.

통지:당첨자 명단은 응모 기간 이후 최대 삼십(30)일 동안 요청 시 확인할 수 있습니다. 소인이 찍힌 봉투를 다음 주소로 보내주세요: 1 Hotel San Francisco, c/o 소셜 미디어팀 - 2024 Martha Stoumen Giveaway, 8 Mission Street, San Francisco, CA 94105.

Dispute Resolution:  Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. Such claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees.
